Pro-forma rental agreement

A short, plain-English NZ machinery rental agreement. Fill in the blanks and sign at pickup.

1. Delivery. The Owner delivers the Item in good working order. The Renter
   inspects the Item at pickup and reports any faults immediately.

2. Payment. The Renter pays the Owner directly at the Daily rate for each
   day / week / month until either party cancels. HIREnz.co.nz charges no listing
   fee or commission. Rental fees continue to accrue until the Item is
   returned to the Owner.

3. Cancellation & return. Either party may cancel at any time. On
   cancellation the Renter returns the Item to the pickup address in the
   same condition (fair wear and tear excepted) within 24 hours.

4. Use. The Renter will use the Item only for its intended purpose, comply
   with all NZ laws (including the Health and Safety at Work Act 2015),
   and keep the Item securely stored when not in use.

5. Damage & loss. The Renter is liable for any damage, loss or theft of
   the Item during the rental period, except normal wear and tear. The
   Owner may recover repair or replacement cost from the Renter.

6. Insurance. The Renter is strongly encouraged to hold appropriate
   machinery/plant hire insurance for the rental period. See

7. Liability. To the extent permitted by law, HIREnz.co.nz is a marketplace only
   and is not a party to this agreement. The Consumer Guarantees Act 1993
   does not apply where the Item is acquired for business purposes.

8. Governing law. New Zealand law applies. Any dispute is to be resolved
   in the District Court closest to the Owner's address.
